I know a little legal stuff about registering a trademark and to do that it needs to already be on something or you have to have a heap of money. Also how is the judge supposed to know what he is trademarking without something to see. It's possible that it's only a concept thus far, but keep in mind that big game developers also have been know to keep things under wraps due to release dates.
